A surfer may chose to run you over and that is wrong. If you are in their way you are wrong too.

think of it like this .....say there is a water slide and you are riding it except before the end there is someone in your way. They know you are coming down the slide but they remain in your way. Maybe they slipped and fell or got stuck or something but you may get hurt trying to avoid them and you won't be able to finish your ride. You should try to not run them over but at the same time they should not be there in your way.

It's amazing how only Jaffa said that the surfer involved in the accident shouldn't have done what he did! And that he was damn stupid.
