British Airways - Will I get compensation?

So, when I flew out to Sydney a few weeks ago, British Airways very kindly added a whole new ding to the board...

Its actually a bit worse than it looks in the photo, as it went right down into the core of the board

Ive just posted a letter to BA baggage claims asking them to cough up for the price of replacing the board (£425). So what do you think their response will be....?

Also is it British Airways that have to cough up a few million quid anyway ?
I dont think that another £500.00 on top of that would hurt them much ??

I voted before I read the post and thought it was something to so with the fuel surcharges. I don't think you'll get any money, they'll say you should have had insurance.

yeah, i heard they've just been fined £270 million for operating in a cartel. Surely they can stretch to another board.

You should write to them explaining what happened and say if they do not respond within 30 days then you will take further action and take them to a small claims court...
Theres loads of good info on the net which explains how to do things like this since a lot of companies tend to ignore people.

Big companies *always* have get out clauses, they'll probably find some excuse.

Good Luck.

The last time I flew with my board it was with Air New Zealand. They charged an excess fee for it and also I had to sign a disclaimer basically saying they were not liable for any damage they did to the board in transit.
Nice

Hmmmm, I like your thinking

I was thinking the other day that I'd like basically the same board but 2-3" shorter....

I drove down. It took me 3hrs once i was in france, nothing on the motorways in France as you have to pay.
Mind you it broke my car (Volvo T5). I drove down from Newcastle to the ferry and the people i was with took turns in France. They got confused by the KPH & MPH, so we did 130mph alot = warpped turbo. I was asleep in the back most of the time, right up until the OBD light came on.

A lot of airlines are doing this now!

Here's something from the BA website:

15e2) Our liability for damage to your baggage, including damage caused by delay, is limited by the convention to 1,000 SDRs (approximately £820) except where you prove that the damage resulted from an act or omission by us or our agents carried out either:

- with the intention of causing damage; or
- recklessly and with knowledge that damage would probably result, and you prove that our employees or agents responsible for the act or omission were acting within the scope of their employment.

So YOU have to prove that they damaged it on purpose or were acting in a way that would they knew damage would probably result

How the hell do you prove that :?

A drawing! That'll tie them straight to it! Caught red (crayon) handed.

I think you should just throw the biggest fuss you possibly can. They are real pansies in the end. I really hope you do get the full cash back or a replica board because this year I've been fleshed around by airline companies so much..I think with the amount of money I have spent they can buy you a new board! :D

Good luck!

You might of had a better chance if you checked it out in the airport terminal. They might (probably) won't do anything since it could of happened after you left.

i agree with this, let them no how disappointed you are by their levels of service i.e. crew acting negligently resulting in the damage to your board, also send photos etc letting them know that you are serious.

go onto consumeractiongroup.co.uk there will be info on there about registering with a small claims court etc.

Also can i ask; did you not have insurance because surely it would cover your booard depending on the terms and conditions i.e. you told them it was a surfing holiday. hope it helps
